A CHINCHILLA man has been fined $1000 and disqualified from holding/ obtaining a driver’s licence for six months when he appeared in Chinchilla Magistrates Court last Thursday.

David George Elder, 76, pleaded guilty to driving without due care and attention or driving without reasonable consideration for other persons using road or place.

Police said Elder had been driving a van with four passengers when he attempted a u-turn on the Leichhardt Highway on April 19, 2017 when a garbage truck travelling behind hit the van.

One 90-year-old passenger died, while another 83-year-old passenger suffered internal injuries. Two other passengers (aged 88 and 91) received minor injuries.

Elder received minor injuries and the driver of the garbage truck was uninjured.

Magistrate Davies described the offence by Elder, who has no prior traffic history, as “a ridiculous manoeuvre on the highway” that had “dreadful consequences”.
