Spent con­vic­tion re­quest de­nied

A judge has re­fused to grant a spent con­vic­tion to a woman caught with 3.5g of metham­phetamine and scales in a Won­thella carpark.

Ni­cole Penn ap­peared in Ger­ald­ton Mag­is­trate’s Court last Fri­day charged with pos­ses­sion.

The court was told po­lice found the drugs in three clip seal bags dur­ing a search of her car on Fe­bru­ary 24.

Pros­e­cut­ing Sergeant Jo Mor­ris­sey op­posed a spent con­vic­tion on the ba­sis Penn had been granted spent con­vic­tions in 1996 and 2012 for cannabis and weapons charges.

Mag­is­trate Donna Webb said Penn had been given enough chances, adding she was con­cerned her drug use had “es­ca­lated” from cannabis to meth.

She was fined $100 and or­dered to pay $190.85 in costs.
