To be con­sid­ered au­then­tic bour­bon, US law states that the spirit must be pro­duced in the United States; be made from grain at least 51 per cent corn; be aged in new, charred, oak bar­rels; be dis­tilled to no more than 160 proof (80 per cent al­co­hol by vol­ume); has to en­ter the bar­rel for ag­ing at no more than 125 proof; and be bot­tled at 80 proof or more.
