Builder cops fraud, negligence fine
A former registered Broome builder has been fined $20,000 by an industry watchdog for a string of fraud and negligent conduct.
The Building Services Board penalty related to work Dominic Jon Della Franca — trading as Dom Della Constructions — carried out on three Broome properties and jobs for a landscaping contractor for the shires of Tom Price and Ashburton.
The BSB said it accepted his admission that he was fraudulent under the Building Services (Registration) Act 2011.
Mr Della Franca provided 24 false subcontractor invoices, timesheets and variations worth more than $234,000 to one of the property owners in order to benefit his financial position.
He also provided 16 false requests for reimbursement and/or invoices totalling $106,000 to two companies that employed him as contract manager in order to benefit his financial position.
The BSB said Mr Della Franca accepted negligence by demanding and receiving payments in relation to all three of the projects when had no contractual right to do so and did not account for them.
He wrongly demanded and received payments for two of the home building contracts prior to providing the owners with a certificate of home indemnity insurance.
In February this year, Mr Della Franca was convicted of 22 counts of uttering a forged record with intent to defraud and two counts of stealing.
He was sentenced to three years imprisonment, conditionally suspended for two years, with a restitution order of $18,300 in favour of the home owner.
