Builder cops fraud, neg­li­gence fine

A for­mer reg­is­tered Broome builder has been fined $20,000 by an in­dus­try watch­dog for a string of fraud and neg­li­gent con­duct.

The Build­ing Ser­vices Board penalty re­lated to work Do­minic Jon Della Franca — trad­ing as Dom Della Con­struc­tions — car­ried out on three Broome prop­er­ties and jobs for a land­scap­ing con­trac­tor for the shires of Tom Price and Ash­bur­ton.

The BSB said it ac­cepted his ad­mis­sion that he was fraud­u­lent un­der the Build­ing Ser­vices (Reg­is­tra­tion) Act 2011.

Mr Della Franca pro­vided 24 false sub­con­trac­tor in­voices, timesheets and vari­a­tions worth more than $234,000 to one of the prop­erty own­ers in or­der to ben­e­fit his fi­nan­cial po­si­tion.

He also pro­vided 16 false re­quests for re­im­burse­ment and/or in­voices to­talling $106,000 to two com­pa­nies that em­ployed him as con­tract man­ager in or­der to ben­e­fit his fi­nan­cial po­si­tion.

The BSB said Mr Della Franca ac­cepted neg­li­gence by de­mand­ing and re­ceiv­ing pay­ments in re­la­tion to all three of the projects when had no con­trac­tual right to do so and did not ac­count for them.

He wrongly de­manded and re­ceived pay­ments for two of the home build­ing con­tracts prior to pro­vid­ing the own­ers with a cer­tifi­cate of home in­dem­nity in­sur­ance.

In Fe­bru­ary this year, Mr Della Franca was con­victed of 22 counts of ut­ter­ing a forged record with in­tent to de­fraud and two counts of steal­ing.

He was sen­tenced to three years im­pris­on­ment, con­di­tion­ally sus­pended for two years, with a resti­tu­tion or­der of $18,300 in favour of the home owner.
