Tiler or­dered to pay $178,000

A JAN­DAKOT tiler has been or­dered to pay more than $178,000 af­ter be­ing pros­e­cuted by the Build­ing Com­mis­sioner for of­fences be­tween June 2011 and March 2013.

Jose An­to­nio Ar­guijo, the sole di­rec­tor and sec­re­tary of Plaza Tiling, en­tered into con­tracts with two prop­erty own­ers in Rock­ing­ham and Como to un­der­take bath­room and tiling ren­o­va­tions at two houses on each site.

The con­tracts were val­ued at be­tween $29,000 and $157,000.

On March 2, the Perth Mag­is­trates Court or­dered Mr Ar­guijo to pay $67,000 in fines, $110,000 in com­pen­sa­tion and $1700 in costs af­ter find­ing him guilty on 14 charges un­der the Home Build­ing Con­tracts Act 1991.

The court found Plaza Tiling failed to en­sure con­tracts signed were up to stan­dard, had re­ceived a de­posit in ex­cess of 6.5 per cent of the to­tal value of work, had failed to ob­tain a pol­icy of home in­dem­nity in­sur­ance and de­manded progress pay­ments for in­com­plete work.

On one Rock­ing­ham con­tract the owner paid the com­pany more than $122,000 only for the com­pany to cease work af­ter 38 tiles were laid.

Build­ing Com­mis­sioner Peter Gow said in­for­ma­tion on con­sumers’ rights was avail­able on the Build­ing Com­mis­sion web­site.
