Tiler ordered to pay $178,000
A JANDAKOT tiler has been ordered to pay more than $178,000 after being prosecuted by the Building Commissioner for offences between June 2011 and March 2013.
Jose Antonio Arguijo, the sole director and secretary of Plaza Tiling, entered into contracts with two property owners in Rockingham and Como to undertake bathroom and tiling renovations at two houses on each site.
The contracts were valued at between $29,000 and $157,000.
On March 2, the Perth Magistrates Court ordered Mr Arguijo to pay $67,000 in fines, $110,000 in compensation and $1700 in costs after finding him guilty on 14 charges under the Home Building Contracts Act 1991.
The court found Plaza Tiling failed to ensure contracts signed were up to standard, had received a deposit in excess of 6.5 per cent of the total value of work, had failed to obtain a policy of home indemnity insurance and demanded progress payments for incomplete work.
On one Rockingham contract the owner paid the company more than $122,000 only for the company to cease work after 38 tiles were laid.
Building Commissioner Peter Gow said information on consumers’ rights was available on the Building Commission website.
