Fined for neg­li­gence

A WATER­FORD builder was fined $2500 for neg­li­gent con­duct for work he car­ried out on a Bull­creek prop­erty be­tween Au­gust and De­cem­ber 2013.

The Build­ing Ser­vices Board found Ni­cholas Hunter was neg­li­gent in that he per­formed the work with­out pro­vid­ing a com­ply­ing writ­ten con­tract to the owner and he en­tered into the con­tract that al­lowed him to re­ceive a de­posit of more than 6.5 per cent of the to­tal work value of work.

He also per­formed build­ing work with­out a build­ing per­mit from the City of Melville, but has since ob­tained a ret­ro­spec­tive ap­proval.

The con­tract Mr Hunter en­tered into was for struc­tural work val­ued at more than $14,700 in the kitchen, bath­room and games room.

Mr Hunter had de­manded a de­posit of 70 per cent of the to­tal.

Build­ing Com­mis­sioner Peter Gow said it was the re­spon­si­bil­ity of any­one car­ry­ing out build­ing work to be aware of their le­gal obli­ga­tions.
