Court case resolution not SDRC’s
Regional Council say they had no role to play in legal action being dropped over the Stanthorpe Civic Centre fire. “Council was indemnified for fire damage caused to Stanthorpe Civic Centre in March 2016. Council was fully reimbursed all money it was entitled to under the relevant insurance policy by its insurer,” an SDRC spokeswoman said.
“SDRC has not started nor discontinued any legal proceedings against Brisbane based business, Northern Lifestyle Sports Floors. Legal proceedings in relation to Stanthorpe Civic Centre were instigated by, and at the instruction of Council’s insurer, to resolve insurance claim matters to recover lost funds from a third party insurer.
“While SDRC is listed as the plaintiff on the Queensland Supreme Court Statement of Claim, Council’s insurer exercised its right to action legal proceedings against the third party insurer, the defendant, in order to recover the amount of the insurance claim paid to SDRC. SDRC cannot provide further information as to why court proceedings were ceased,” she said.
