Court case res­o­lu­tion not SDRC’s

Re­gional Coun­cil say they had no role to play in le­gal ac­tion be­ing dropped over the Stan­thorpe Civic Cen­tre fire. “Coun­cil was in­dem­ni­fied for fire dam­age caused to Stan­thorpe Civic Cen­tre in March 2016. Coun­cil was fully re­im­bursed all money it was en­ti­tled to un­der the rel­e­vant in­surance pol­icy by its in­surer,” an SDRC spokes­woman said.

“SDRC has not started nor dis­con­tin­ued any le­gal pro­ceed­ings against Bris­bane based busi­ness, North­ern Life­style Sports Floors. Le­gal pro­ceed­ings in re­la­tion to Stan­thorpe Civic Cen­tre were in­sti­gated by, and at the in­struc­tion of Coun­cil’s in­surer, to re­solve in­surance claim mat­ters to re­cover lost funds from a third party in­surer.

“While SDRC is listed as the plain­tiff on the Queens­land Supreme Court State­ment of Claim, Coun­cil’s in­surer ex­er­cised its right to ac­tion le­gal pro­ceed­ings against the third party in­surer, the de­fen­dant, in or­der to re­cover the amount of the in­surance claim paid to SDRC. SDRC can­not pro­vide fur­ther in­for­ma­tion as to why court pro­ceed­ings were ceased,” she said.
