Charged af­ter be­ing pro­voked

CLADE Court­ney pleaded guilty to one count of con­tra­vene of a Do­mes­tic Vi­o­lence Or­der on Mon­day at Mareeba Mag­is­trates Court.

Po­lice Prose­cu­tor Sergeant Karen Equinox said po­lice were called to the prop­erty and they found a male ly­ing in the drive­way hold­ing ma­te­rial over his eyes.

“As the in­ves­ti­ga­tion has car­ried out, this male has been iden­ti­fied as the ag­grieved. He had been as­saulted and had blood on his sin­glet and head,” she said.

“Court­ney was pro­voked by the ag­grieved, who was yelling and swear­ing at Court­ney. The ag­grieved also had said Court­ney’s mother was de­ceased.”

The court heard that Court­ney had also said and done things in the heat of the mo­ment. Since this in­ci­dent Court­ney has been at­tend­ing a men’s group but he had a lengthy crim­i­nal his­tory with se­ri­ous charges un­til 2013.

Mag­is­trate Kevin Priestly said he ac­cepted the changes Court­ney was mak­ing and prior to 2013, his crim­i­nal his­tory was ap­palling.

“I ac­cept that he has made changes, but this is still a se­ri­ous of­fence. His crim­i­nal his­tory was ap­palling un­til 2013 when he has made some changes,” he said.

He was sen­tenced to 12 months im­pris­on­ment and it will be sus­pended for 18 months af­ter serv­ing three months.
