Charged after being provoked
CLADE Courtney pleaded guilty to one count of contravene of a Domestic Violence Order on Monday at Mareeba Magistrates Court.
Police Prosecutor Sergeant Karen Equinox said police were called to the property and they found a male lying in the driveway holding material over his eyes.
“As the investigation has carried out, this male has been identified as the aggrieved. He had been assaulted and had blood on his singlet and head,” she said.
“Courtney was provoked by the aggrieved, who was yelling and swearing at Courtney. The aggrieved also had said Courtney’s mother was deceased.”
The court heard that Courtney had also said and done things in the heat of the moment. Since this incident Courtney has been attending a men’s group but he had a lengthy criminal history with serious charges until 2013.
Magistrate Kevin Priestly said he accepted the changes Courtney was making and prior to 2013, his criminal history was appalling.
“I accept that he has made changes, but this is still a serious offence. His criminal history was appalling until 2013 when he has made some changes,” he said.
He was sentenced to 12 months imprisonment and it will be suspended for 18 months after serving three months.
