Man cops jail term for sup­ply­ing the woman with drug

A 33-YEAR-OLD man who shared a hit of “ice” with a 35-week preg­nant woman has avoided ac­tual jail time.

How­ever, James Des­mond Macey will have six months jail hang­ing over his head for the next two years af­ter Judge Den­nis Lynch QC or­dered the term be wholly sus­pended.

Pros­e­cu­tor Jen­nifer Cameron told Toowoomba Dis­trict Court po­lice had been called to a re­port of two peo­ple sus­pected to have over­dosed at a Toowoomba res­i­dence on Fe­bru­ary 22.

The preg­nant woman had called po­lice say­ing both had in­jected the drug which ap­par­ently was a “bad batch” and both had be­come ill.

The pair di­rected po­lice to stash of sub­stance which weighed 0.229g andh con­tained ice.

Macey pleaded guilty to sup­ply­ing and pos­sess­ing a danger­ous drug and pos­sess­ing a drug uten­sil.

His bar­ris­ter Frank Martin told the court his client had no pre­vi­ous con­vic­tions at all un­til about 12 months ago when he had be­come drug ad­dicted.

A friend of his client’s had left the drug at his home and though it ap­peared tainted with dif­fer­ent coloured crys­tals he and the woman had de­cided to use it any­way, he said.

His client had since re­turned to live with his par­ents and had sought help for his ad­dic­tion, Mr Martin sub­mit­ted.

Judge Lynch noted Macey had led a use­ful and un­blem­ished life un­til be­com­ing ad­dicted to ice and sen­tenced him six months in jail but or­dered the whole term be sus­pended for two years.
