A NSW Sen­ate in­quiry has heard white-col­lar work­ers are in­creas­ingly be­ing treated as in­de­pen­dent con­trac­tors, al­low­ing em­ploy­ers to avoid pay­ing en­ti­tle­ments. In its sub­mis­sion, the Le­gal Aid Commission of NSW claimed such “sham con­tract­ing” was rife in low-skilled and low-paid in­dus­tries. Le­gal Aid also cited in­creased cases of em­ploy­ers re­quir­ing em­ploy­ees to set up a pro­pri­etary lim­ited com­pany.
