Palm Is­land stolen sex tape charge

A CLIP of a Palm Is­land cou­ple per­form­ing ex­plicit sex­ual acts has been dis­trib­uted widely in the com­mu­nity, al­legedly by a ju­ve­nile and his friend who broke into their home.

The Townsville Chil­dren’s Court has heard a com­plainant fe­male and a male part­ner con­sen­su­ally made the p r i v a t e v i d e o r e c o r d i n g un­be­knownst to them that it would be seen by any­one else.

How­ever since the two al­leged of­fend­ers came into pos­ses­sion of the clip last month, it has al­legedly been sent via text mes­sage and blue-tooth to sev­eral other mem­bers of the pub­lic.

A 15-year-old Palm Is­land boy faced seven charges in a closed pro­ceed­ing, in­clud­ing en­ter dwelling, s t eali ng, dis­tribut­ing a pro­hib­ited vis­ual record­ing and as­sault oc­ca­sion­ing bod­ily harm.

His co-ac­cused is yet to ap­pear on sim­i­lar of­fences be­fore the Townsville Mag­is­trates Court.

Sgt Harms said at 1am on March 11, 2011, the two males are al­leged to have bro­ken into a Palm Is­land home.

‘‘ They lo­cated a mo­bile phone and $ 80 in a wal­let,’’ Sgt Harms said.

How­ever the stolen phone con­tained the ex­plicit record­ing which is then al­leged to have been dis­trib­uted by the pair.

Two days later the vic­tim re­ceived i nfor­ma­tion t he child had her mo­bile, went to con­front the de­fen­dant, and was as­saulted.

Mag­is­trate Brian Smith or­dered the de­fen­dant be re­leased on the con­di­tion he resided with his aunt on the is­land, abides by a 9pm to 6am cur­few and have no con­tact with the com­plainant or his co-ac­cused. The mat­ter was ad­journed to the Palm Is­land Mag­is­trates Court un­til March 23.
