New de­lay in Brunker case

THE hear­ing of an al­leged as­sault case in­volv­ing Whit­sun­day Re­gional Coun­cil Mayor Mike Brunker has been ad­journed a fourth time af­ter Bowen Mag­is­trate Athol Kennedy dis­qual­i­fied him­self from the mat­ter. Mag­is­trate Kennedy has re­port­edly made the de­ci­sion to be re­moved due to a con­flict of in­ter­est as he is said to know Mr Brunker, the al­leged vic­tim. Bowen Rac­ing Club pres­i­dent Cyril Vains was listed to ap­pear on a charge of com­mon as­sault at Bowen Mag­is­trates Court yes­ter­day. The Townsville Bul­letin un­der­stands the mag­is­trate ad­journed the mat­ter to get a re­place­ment mag­is­trate from Townsville or Mackay. Mr Vains had ear­lier at­tempted to re­move Mag­is­trate Kennedy and the Bowen­based po­lice pros­e­cu­tor, Sgt Dave Blun­dell, from the case af­ter al­leg­ing a pos­si­ble bias. No date for the mat­ter has been set.
