Man faces two child sex counts

A MAN vis­it­ing fam­ily in Townsville al­legedly touched his 13- year- old great- nephew in­de­cently af­ter giv­ing him a PlayStation.

The man pleaded not guilty in Townsville Dis­trict Court yes­ter­day to two counts of in­de­cent treat­ment of a child and is fac­ing trial.

Crown prose­cu­tor Jodie Crane said the Queens­land man was vis­it­ing his niece and her fam­ily in Townsville from March 1, 2015.

“He was very gen­er­ous with them, he bought all of the chil­dren gifts when he ar­rived,” she said.

“On the first week­end that he was there, the de­fen­dant also bought ( the com­plainant and his brother) a PlayStation and tele­vi­sion, which was set up in ( the com­plainant’s) room.”

Ms Crane said on Sun­day, March 8, the boy and his great- un­cle were “play- fight­ing” in the kitchen for two min­utes. She said the man al­legedly touched the boy’s gen­i­tal area twice.

“( The boy) says that af­ter the de­fen­dant touched him on the pe­nis, ( he) said ‘ you’re a feeler’ and ( his great- un­cle) re­sponded ‘ yeah, I know’,” she said.

Ms Crane said the next af­ter­noon, the boy was ly­ing on his bed play­ing with the PlayStation when his grea­tun­cle strad­dled him and gave him a mas­sage. He al­legedly mas­saged down the boy’s back and again touched him in­ap­pro­pri­ately.

“( The boy) then rolled over and tried to get the de­fen­dant off him, he says that the de­fen­dant grabbed his arms and held them around the wrist, up be­hind his head, in what ( the boy) de­scribes as ‘ like muck­ing around’ ... and the de­fen­dant says ‘ I’m too strong for you’,” Ms Crane said.

“It’s around this point that ( the boy) says his brother walked into the room. He says that the de­fen­dant then got off him and left.”

Ms Crane said the boy told his sis­ter the great- un­cle had touched him.

She said that night, the mother was told of the com­plaint af­ter the fam­ily went out to din­ner.

The trial is ex­pected to con­tinue to­day.
