Su­bi­aco to ap­peal decision

SU­BI­ACO will re­turn to the Supreme Court to ap­peal its failed lit­i­ga­tion against the State Gov­ern­ment merg­ers process in ei­ther March or April 2015, says chief ex­ec­u­tive Stephen Tin­dale.

Mr Tin­dale said the City lodged its ap­peal on De­cem­ber 15 and ex­pected to re­ceive a re­sponse in Jan­uary.

He said their ap­peal ar­gued that Chief Jus­tice Wayne Martin “erred in the de­ci­sions he made on three grounds” at the Novem­ber 25 hear­ing.

“Among a good num­ber of elected mem­bers and com­mu­nity mem­bers, the con­flict of in­ter­est ar­gu­ment holds a lot of sway,” he said.

“The Chief Jus­tice's decision ba­si­cally says: ‘It's okay to have gov­ern­ment em­ploy­ees on sup­pos­edly in­de­pen­dent ad­vi­sory boards that have a sole role to pro­mote lo­cal gov­ern­ment re­form’.

“That just does not ring true.”
