Prison sen­tence for lo­cal man

A CANNONVALE man has been sen­tenced to 15 months im­pris­on­ment, with a two year sus­pended sen­tence af­ter serv­ing five months.

Zachary John Hall pleaded guilty in Proser­pine Mag­is­trate’s Court on Mon­day to con­tra­ven­ing the di­rec­tion or re­quire­ment of po­lice, two counts of con­tra­ven­ing a pro­ba­tion or­der, breach of bail un­der­tak­ing and pos­ses­sion of danger­ous drugs.

On June 30 at 9.50pm, Whit­sun­day Po­lice is­sued Hall with a re­quest for iden­ti­fi­ca­tion no­tice but Hall failed to at­tend the sta­tion within seven days.

On July 15, Hall was is­sued a no­tice to ap­pear in court on July 29, but failed to at­tend and a war­rant was is­sued for his ar­rest.

On July 30, po­lice ex­e­cuted a search war­rant for drugs at a Martin’s Lane res­i­dence in Cannonvale at 9.01am.

Hall was found asleep in a bed­room, with a small glass bowl con­tain­ing 0.4g of cannabis and 5.2g of cannabis in a clip seal bag on the bed­side ta­ble.

Mag­is­trate Haydn St­jern­qvist said Hall had con­tin­ued to com­mit other of­fences while on pro­ba­tion.

“You have been given am­ple op­por­tu­nity over the past two years to seek out coun­selling and com­mu­nity ser­vice sup­port and you have not done that,” he said.

One of the charges re­lat­ing to con­tra­ven­ing a pro­ba­tion or­der was re­voked and the other ex­pired which lead to Hall be­ing re­sen­tenced on the orig­i­nal charges dur­ing pro­ceed­ings.

For fail­ing to ap­pear in ac­cor­dance with un­der­tak­ing, Hall re­ceived a three month cu­mu­la­tive sen­tence as part of a 12 month sen­tence.

The charge re­lat­ing to con­tra­ven­ing the di­rec­tion or re­quire­ment of po­lice was con­victed with no fur­ther pun­ish­ment.

Hall will face a fur­ther hear­ing re­gard­ing charges of com­mon as­sault, con­tra­ven­tion of re­lease con­di­tions and wil­ful dam­age in court at a later date.
