Father’s ‘foolish decision’ to drive
A FATHER who lost control of his van after drinking six Jack Daniel’s cans allegedly told police he didn’t think he’d be over the limit to drive.
Timothy James Kruck had his nine-year-old daughter in the van when he skidded off the tarmac near the Tropic Road roundabout in Cannonvale at 9pm on May 8.
In court on Monday, prosecutor Elizabeth Smith said police arrived on the scene to find skid marks on the road, a damaged traffic sign and a white Toyota van parked on the grass. She said Kruck, who returned a breath-alcohol reading of 0.208%, told police he was heading to McDonald’s to get something to eat.
In his defence, the 34-yearold from East Mackay said he’d made a “foolish decision” that night.
Magistrate Haydn Stjernqvist questioned how Kruck could have thought he’d be okay to drive given the reading didn’t have “much grey in it”.
Kruck was fined $1200 and disqualified from driving for 11 months.
