Fa­ther’s ‘fool­ish de­ci­sion’ to drive

A FA­THER who lost con­trol of his van af­ter drink­ing six Jack Daniel’s cans al­legedly told po­lice he didn’t think he’d be over the limit to drive.

Ti­mothy James Kruck had his nine-year-old daugh­ter in the van when he skid­ded off the tar­mac near the Tropic Road round­about in Can­non­vale at 9pm on May 8.

In court on Mon­day, pros­e­cu­tor El­iz­a­beth Smith said po­lice ar­rived on the scene to find skid marks on the road, a dam­aged traf­fic sign and a white Toy­ota van parked on the grass. She said Kruck, who re­turned a breath-al­co­hol read­ing of 0.208%, told po­lice he was head­ing to McDon­ald’s to get some­thing to eat.

In his de­fence, the 34-yearold from East Mackay said he’d made a “fool­ish de­ci­sion” that night.

Mag­is­trate Haydn St­jern­qvist ques­tioned how Kruck could have thought he’d be okay to drive given the read­ing didn’t have “much grey in it”.

Kruck was fined $1200 and dis­qual­i­fied from driv­ing for 11 months.
