Fi­nal chance for re­cur­rent drug of­fender

A FES­TI­VAL-GOER has barely es­caped jail time af­ter be­ing caught in the pos­ses­sion of cannabis and a home­made smok­ing uten­sil

On May 10, po­lice were on pa­trol dur­ing the Groov­ing the Moo con­cert in Townsville when they no­ticed a ve­hi­cle parked at a McDon­ald’s restau­rant.

Po­lice in­spected the car and found Caleb Luke Jones sit­ting in the pas­sen­ger seat.

Po­lice pros­e­cu­tor El­iz­a­beth Smith said the 32-yearold lo­cal smelt of cannabis.

A search re­vealed a con­tainer that held 0.51g of cannabis and an Oak milk bot­tle that had been turned into a wa­ter pipe. Af­ter lis­ten­ing to the facts, mag­is­trate Haydn St­jern­qvist noted the de­fen­dant had last year been sent to drug di­ver­sion – “which you breached”.

Jones was sen­tenced to four months im­pris­on­ment for the pos­ses­sion of cannabis and two months for hav­ing the wa­ter pipe.

Both pe­ri­ods of im­pris­on­ment were wholly suspended for 12 months.
