Jail time for eye punch

A 35-YEAR-OLD Can­non­vale man will serve time in prison af­ter plead­ing guilty to punch­ing his part­ner in the eye.

The man ap­peared in cus­tody at Proser­pine Mag­is­trates Court on Mon­day, where it was also heard he’d had seven do­mes­tic vi­o­lence re­lated charges in the past four years.

Po­lice were called around 2.45am on May 22 to a house in Can­non­vale where po­lice prose­cu­tor Bern­hard Berger said they found a woman in a bed­room with “bruis­ing on her left eye lid and swelling on her cheek”.

Af­ter po­lice spoke with both of them sep­a­rately, the man de­nied a phys­i­cal al­ter­ca­tion had taken place. He was ar­rested and charged with con­tra­ven­ing a do­mes­tic vi­o­lence pro­tec­tion or­der.

The woman also ap­peared in court where she spoke with Mag­is­trate Ron Muir­head and con­firmed she wished to leave the Air­lie Beach area.

In sen­tenc­ing, Mr Muir­head said the man was not a first of­fender, had nu­mer­ous do­mes­tic vi­o­lence breaches in the past and that he con­tin­ued to of­fend.

He was sen­tenced to six months prison, with seven days time al­ready served and given a pa­role re­lease date of July 22, 2017. A con­vic­tion was recorded.
