Sex­ual com­ment leads to as­sault

A CAN­NON­VALE man didn’t in­tend to as­sault a man who made an ex­plicit com­ment to his part­ner.

But af­ter Adam Chris­tian Cheers, 45, con­fronted a man at Banjo’s on Is­land Dr who al­legedly told his part­ner “I only have so much time to f... you” he took mat­ters into his own hands.

Pros­e­cu­tor Bern­hard Berger said on Septem­ber 24 at 3pm Cheers and his fe­male part­ner had a late lunch at the venue.

As the cou­ple left, Cheers’ part­ner told him about the com­ment made by the man who she had asked for a cig­a­rette, and Cheers re­turned to Banjo’s to con­front him.

The vic­tim was punched in the head and struck mul­ti­ple times be­fore Cheers was told to leave.

De­fence lawyer David Fitzger­ald said Cheers’ in­ten­tion was to have a “stern word”.

“He said he doesn’t ac­cept that the com­ment made to his part­ner was ap­pro­pri­ate to (jus­tify) en­gag­ing in phys­i­cal ret­ri­bu­tion,” Mr Fitzger­ald said.

Chief Mag­is­trate Orazio Rin­audo told Cheers his ac­tions were “dis­pro­por­tion­ate”.

He was fined $500.
