Sexual comment leads to assault
A CANNONVALE man didn’t intend to assault a man who made an explicit comment to his partner.
But after Adam Christian Cheers, 45, confronted a man at Banjo’s on Island Dr who allegedly told his partner “I only have so much time to f... you” he took matters into his own hands.
Prosecutor Bernhard Berger said on September 24 at 3pm Cheers and his female partner had a late lunch at the venue.
As the couple left, Cheers’ partner told him about the comment made by the man who she had asked for a cigarette, and Cheers returned to Banjo’s to confront him.
The victim was punched in the head and struck multiple times before Cheers was told to leave.
Defence lawyer David Fitzgerald said Cheers’ intention was to have a “stern word”.
“He said he doesn’t accept that the comment made to his partner was appropriate to (justify) engaging in physical retribution,” Mr Fitzgerald said.
Chief Magistrate Orazio Rinaudo told Cheers his actions were “disproportionate”.
He was fined $500.
