On Sept. 17, 1999, the Supreme Court of Canada ac­quit­ted Don­ald Marshall Jr. of Mem­ber­tou on three charges of il­le­gally catch­ing eels, say­ing a 1760 treaty with the Bri­tish gave his Mi’kmaq band the right to catch fish and sell them for sus­te­nance.
