Residential construction on farm land rules changing
The Memphremagog MRC, the Commission de protection du territoire agricole du Quebec Union des producteurs agricoles an agreement regarding article 59 of the Loi sur la protection du territoire et des activites agricoles, allowing for a global approach in the handling of requests for residential usage in agricultural zones in the Memphremagog MRC.
In effect, Article 59 of the law has allowed the MRC to depose a collective request that offers them the possibility to plan, with a perspective of sustainable development of agricultural activities, residential construction in agricultural zones. The
aim of the request is to assure better protection of agricultural activities and to establish clear regulations regarding the implantation of new residences.
In the territory of the Memphremagog MRC, residential construction will be authorized in the following, defined sectors: small parcels of de-structured agricultural land already mostly occupied by non-agricultural within the agricultural zone where new residences could be built on land small enough not to de-structure the surrounding agricultural land (30.5 % of the MRC’S
In the Memphremagog MRC, this represents in total a little more than 700 possible new residences within the permanent agricultural zone.
The conclusion of this agreement will facilitate the process of citizens wishing to construct a new residence in a sector targeted by these negotiations. In effect, those individuals will not have to make an individual demand to the CPTAQ since it will be clearly determined in which cases and under what conditions it is possible to construct.
