Fa­tal­ity In­quiry set for Fen­tanyl over­doses

A Fa­tal­ity In­quiry into the deaths of two in­mates on Christ­mas Eve 2011 is set to go next month.

A pre In­quiry Con­fer­ence was held at the Drumheller Court House on Fri­day, De­cem­ber16 for Derek Brian Up­ton, 36 and Ni­cholas Perry Whynott, 24.

Shortly af­ter 3 a.m. on De­cem­ber 24, 2011 dur­ing cell checks, in­mate Whynott was found un­re­spon­sive in his cell. Staff ini­ti­ated treat­ment and EMS was dis­patched. He was pro­nounced dead at the Drumheller Health Cen­tre. He was serv­ing six years for drug charges.

RCMP were called to at­tend at the In­sti­tu­tion and while they were in­ves­ti­gat­ing, a sec­ond in­mate was found to be un­re­spon­sive. Up­ton was taken to the Drumheller Health Cen­tre where he was later pro­nounced dead. He was serv­ing a life sen­tence for mur­der.

In April of 2012, The Mail re­ported tox­i­col­ogy re­ports have been com­pleted and both in­mates were found to have toxic lev­els of Fen­tanyl in their bod­ies.

The In­quiry is sched­uled to run from Jan­uary 30 to Fe­bru­ary 1. Judge G.L. Gash­ler is to hear the In­quiry.
