Jail time for forced entry
A man who kicked in a door so he could get a cellphone he left behind was sentenced Monday to serve 10 days in jail.
Daniel Gerald O’Shea appeared before Judge John Douglas in provincial court in Charlottetown for sentencing to charges that include forcible entry.
The court heard O’Shea got into an argument with a woman at the house after a night of drinking. She asked him to leave and once he was outside O’Shea wanted to go back in to get his cellphone.
After several attempts to get inside O’Shea kicked in the back door.
While inside he hit the woman in the face.
O’Shea didn’t have a prior criminal record, and the defence told the court he has since taken steps to address his drinking, which played a role in the incident.
Along with the jail time, O’Shea will be on probation for one year once he is released and must pay $200 in victims of crime surcharges.
