Jail time for forced en­try

A man who kicked in a door so he could get a cell­phone he left be­hind was sen­tenced Mon­day to serve 10 days in jail.

Daniel Ger­ald O’Shea ap­peared be­fore Judge John Dou­glas in pro­vin­cial court in Char­lot­te­town for sen­tenc­ing to charges that in­clude forcible en­try.

The court heard O’Shea got into an ar­gu­ment with a woman at the house af­ter a night of drink­ing. She asked him to leave and once he was out­side O’Shea wanted to go back in to get his cell­phone.

Af­ter sev­eral at­tempts to get in­side O’Shea kicked in the back door.

While in­side he hit the woman in the face.

O’Shea didn’t have a prior crim­i­nal record, and the de­fence told the court he has since taken steps to ad­dress his drink­ing, which played a role in the in­ci­dent.

Along with the jail time, O’Shea will be on pro­ba­tion for one year once he is re­leased and must pay $200 in vic­tims of crime sur­charges.
