By Sunday, July 15 RCMP were searching the site of the alleged attack, located in the East End Channel area of town in an overgrown field near Shark Cove Suites. By Monday, July 17 Kavanagh was released from custody, the Crown having withdrawn all charges against him.

The initial complainant was subsequently charged with mischief. That same afternoon RCMP once again searched the field, this time using a metal detector.
