In­de­cent act at red light re­sults in pro­ba­tion

A Thorold man caught mas­tur­bat­ing at a red light has been placed on pro­ba­tion for 18 months.

Kevin Ser­vos pleaded guilty in On­tario Court of Jus­tice in St. Catharines on Wed­nes­day to a charge of com­mit­ting an in­de­cent as­sault.

In Oc­to­ber 2017 shortly be­fore 9 a.m., court was told, a woman was driv­ing a “higher SUV” along Glen­dale Av­enue on her way to work when she stopped at a red light and no­ticed the driver be­side her was look­ing at her and mas­tur­bat­ing.

The woman took pho­to­graphs of the man with her cell­phone and con­tin­ued on to work and called po­lice.

As­sis­tant Crown at­tor­ney Graeme Leach told the judge the de­fen­dant was con­victed of a sim­i­lar of­fence in the past and placed on pro­ba­tion.

There could have been ev­i­den­tiary is­sues had the lat­est in­ci­dent gone to trial, he added, as the pho­to­graphs taken by the com­plainant had sub­se­quently been deleted.

Judge Peter Wilkie im­posed an 18-month pro­ba­tion­ary term and or­dered Ser­vos to have no con­tact with the vic­tim.
