In­creas­ing In­tel­lec­tual Prop­erty Pro­tec­tion

Bei­jing Mu­nic­i­pal­ity will fo­cus on ad­vanc­ing it­self into in­tel­lec­tual prop­erty pro­tec­tion, im­prov­ing the qual­ity of cre­ativ­ity, util­i­sa­tion ben­e­fits, and safe­guard­ing ef­fect, man­age­ment abil­i­ties and level of ser­vice.

On April 19, 2017 be­fore the 17th World In­tel­lec­tual Prop­erty Day, a press con­fer­ence cospon­sored by the In­for­ma­tion Of­fice of the Peo­ple’s Govern­ment of Bei­jing Mu­nic­i­pal­ity and an agency in charge of the mu­nic­i­pal in­tel­lec­tual prop­erty of­fice meet­ing was held to in­tro­duce the sta­tus of safe­guard­ing in­tel­lec­tual prop­erty in Bei­jing Mu­nic­i­pal­ity in 2016.

At that time, patent ap­pli­ca­tions reached 189,129, with a year-on-year in­crease of 21 per­cent; the in­ven­tion patent ap­pli­ca­tion quan­tity ex­ceeded 100,000, with a year-onyear in­crease of 17.7 per­cent; the patent au­tho­ri­sa­tion quan­tity reached 100,578, with a year-on-year in­crease of 7 per­cent, the in­ven­tion patent au­tho­ri­sa­tion quan­tity reached 40,602, with a year-on-year in­crease of 15 per­cent.

The hold­ing quan­tity of in­ven­tion patent ev­ery 10,000 peo­ple is 76.8, rank­ing first all over China. As of 18 April 2017, Bei­jing Mu­nic­i­pal­ity has 873,000 valid reg­is­tered trade­marks, 229 China Fa­mous Trade­marks and 683 Bei­jing Fa­mous Trade­marks. Bei­jing has 693,421 items of vol­un­tary reg­is­tered works, 43.3 per­cent of all in China, with a year- on-year in­crease of 15.38 per­cent, hav­ing con­sec­u­tively ranked first for 14 years; and 82,490 com­puter soft­ware copy­right reg­is­tra­tions, 20.2 per­cent of all in China.

Im­prov­ing Poli­cies, Laws and Reg­u­la­tions

In 2016, Bei­jing Mu­nic­i­pal­ity in­ten­si­fied ef­forts in plan­ning and co­or­di­nat­ing the safe­guard­ing the in­tel­lec­tual prop­erty. All mem­ber units have car­ried out their works in safe­guard­ing the in­tel­lec­tual prop­erty in their re­spec­tive ar­eas.

The Bei­jing Mu­nic­i­pal In­tel­lec­tual Prop­erty Meet­ing Of­fice re­leased The 2016 Plan of Car­ry­ing for­ward In­tel­lec­tual Prop­erty Strate­gies in Bei­jing which clar­i­fied seven key jobs and 56 items of spe­cific tasks; worked out “the Work Plan on En­hanc­ing the Plan­ning and Co­or­di­na­tion Func­tions of the Of­fice Meet­ing and Push­ing for­ward the Util­is­ing and Safe­guard­ing of In­tel­lec­tual Prop­erty” and be­gan to es­tab­lish a de­ploy­ment cen­tre in util­is­ing and safe­guard­ing in­tel­lec­tual prop­erty.

In 2017, to adapt to new re­al­i­ties, the Bei­jing Mu­nic­i­pal In­tel­lec­tual Prop­erty Of­fice Meet­ing in­cor­po­rated Bei­jing Mu­nic­i­pal Ad­min­is­tra­tion of Tra­di­tional Chi­nese Medicine as a mem­ber unit, mak­ing mem­ber units reach 42, fur­ther per­fect­ing plan­ning and co­or­di­na­tion.

Over the past year, Bei­jing Mu­nic­i­pal­ity has in­ten­si­fied its pro­fes­sional reg­u­la­tions on ju­ridi­cal pro­tec­tion on in­tel­lec­tual prop­erty. Bei­jing In­tel­lec­tual Prop­erty Court car­ried out re­form on law­suit fil­ing, ver­dicts, and worked out “the Uni­tary Trial Reg­u­la­tions on Law­suit Fil­ing, Judg­ing and Ver­dict” and its match­ing safe­guard­ing mea­sures, to guide judges, lawyers and schol­ars to jointly par­tic­i­pate in and carry out their works un­der uni­tary stan­dards.

In re­gional co­or­di­na­tion, the State In­tel­lec­tual Prop­erty Of­fice has signed the Con­sul­ta­tion Pro­to­col of Pro­mot­ing the Bei­jing, Tian­jin and He­bei Co­or­di­nated De­vel­op­ment and Co­op­er­a­tion on In­tel­lec­tual Prop­erty with the gov­ern­ments of Bei­jing, Tian­jin and He­bei, to pro­mote the co­op­er­a­tion in case af­fir­ma­tion, en­trusted foren­sics and joint law en­force­ment.

Crack­ing Down on Right In­fringe­ment

In 2016, law en­force­ment de­part­ments on in­tel­lec­tual prop­erty across Bei­jing Mu­nic­i­pal­ity have per­formed their re­spec­tive func­tions to carry out spe­cial op­er­a­tions and crack down on the il­le­gal acts of in­fringe­ment.

The Bei­jing In­tel­lec­tual Prop­erty Of­fice has in­ten­si­fied their law en­force­ment on ex­hi­bi­tions, con­fer­ences, and e-com­merce, hav­ing dis­patched about 600 law en­force­ment per­son­nel to carry out law en­force­ment by sta­tion­ing in more than 30 var­i­ous largescale ex­hi­bi­tions and con­fer­ences in­clud­ing the Fourth China Bei­jing In­ter­na­tional Fair for Trade in Ser­vices and the 19th China Bei­jing In­ter­na­tional High-tech Expo.

The Bei­jing Mu­nic­i­pal Bureau of Press, Pub­li­ca­tion, Ra­dio, Film and Tele­vi­sion, unit­ing with de­part­ments of com­mu­ni­ca­tions, cul­tural law en­force­ment and pub­lic se­cu­rity, ac­tively car­ried out the spe­cial op­er­a­tion of “Sword In­ter­net 2016” and the spe­cial prob­lem-ad­dress­ing op­er­a­tion on reg­u­lat­ing the copy­rights of on­line cloud stor­age space.

Bei­jing Ad­min­is­tra­tion for In­dus­try and Com­merce car­ried out spe­cial law en­force­ment op­er­a­tions on safe­guard­ing icons of the Olympic Games. Bei­jing Mu­nic­i­pal Pub­lic Se­cu­rity Bureau car­ried out ac­tions such as the “2016 Spring and Sum­mer Safety Op­er­a­tion” to crack down on abus­ing food ad­di­tives.

Bei­jing Cus­toms District car­ried out the “Re­fresh­ing Breeze Op­er­a­tion,” the joint law en­force­ment op­er­a­tion be­tween the cus­toms of China and the United States, and be­tween China and Rus­sia to crack down on law-break­ing ac­tions in­volv­ing key desti­na­tions of im­ports and ex­ports, as well as key com­modi­ties, so as to main­tain an

over­seas “Made in China” im­age.

While car­ry­ing out spe­cial op­er­a­tions of law en­force­ment, law en­force­ment de­part­ments on in­tel­lec­tual prop­erty also em­pha­sised on tak­ing pre­cau­tions by tak­ing ef­fec­tive mea­sures. The Bei­jing In­tel­lec­tual Prop­erty Bureau es­tab­lished a ser­vice cen­tre and work sta­tion for re­port­ing on and com­plaints about in­tel­lec­tual prop­erty is­sues in Yan­qing Sub­park of Zhong­guan­cun Science and Tech­nol­ogy Park.

The In­te­grated Law En­force­ment on Cul­tural Market of Bei­jing Mu­nic­i­pal­ity has launched trial op­er­a­tions of copy­right pro­tec­tion on the In­ter­net video with wide­spread so­cial at­ten­tion and fre­quent in­fringe­ment records, of­fer­ing a timely green chan­nel for copy­right hold­ers who make pre­cau­tion­ary ap­peals to safe­guard their rights and in­crease pro­tec­tion of copy­right hold­ers.

Car­ry­ing out Pub­lic­ity and Ex­changes

In 2016, the ef­fect of in­tel­lec­tual prop­erty on “Es­tab­lish­ing a Sound In­ter­na­tional Im­age of Bei­jing” has re­vealed it­self daily. Bei­jing Mu­nic­i­pal­ity and the State In­tel­lec­tual Prop­erty Of­fice suc­cess­fully held the “Belt and Road Ini­tia­tives In­tel­lec­tual Prop­erty High-level Con­fer­ence” and the “Third China-united King­dom In­tel­lec­tual Prop­erty Sem­i­nar,” as well as the sem­i­nars on the safe­guard­ing and util­is­ing in­tel­lec­tual prop­erty in France and the United States with the two coun­tries’ or­gan­i­sa­tions sta­tioned in China. By re­ly­ing on six in­tel­lec­tual prop­erty in­ter­na­tional ex­change and com­mu­ni­ca­tion bases, 22 es­tab­lished over­seas sta­tions in Asia, Amer­ica, Europe, and Aus­tralia to ex­pand for­eign ex­change and co­op­er­a­tion.

Mem­ber units of the In­tel­lec­tual Prop­erty Of­fice Meet­ing took oc­ca­sions as the World In­tel­lec­tual Prop­erty Day on April 26 to pop­u­larise the laws and reg­u­la­tions on in­tel­lec­tual prop­erty, hav­ing fur­ther raised in­tel­lec­tual prop­erty aware­ness of the pub­lic. The Bei­jing Ad­min­is­tra­tion for In­dus­try and Com­merce held a press con­fer­ence to dis­close work on safe­guard­ing trade­mark in­tel­lec­tual prop­erty by the in­dus­trial and com­merce de­part­ments of Bei­jing Mu­nic­i­pal­ity in 2016, and ex­pose the “Ten Typ­i­cal Cases” with the names of vi­o­la­tors.

The Bei­jing Mu­nic­i­pal Bureau of Press, Pub­li­ca­tion, Ra­dio, Film and Tele­vi­sion car­ried out its 6th Mu­sic In­tel­lec­tual Prop­erty Safe­guard­ing and In­dus­trial De­vel­op­ment Forum. The In­te­grated Law En­force­ment on Cul­tural Market of Bei­jing Mu­nic­i­pal­ity or­gan­ised and held an ac­tiv­ity to in­spect in­fringe­ments and do away with il­le­gal pub­li­ca­tions on World In­tel­lec­tual Prop­erty Day, show­ing the de­ter­mi­na­tion and will of the govern­ment in crack­ing down on pi­rated prod­ucts.

Bei­jing In­tel­lec­tual Prop­erty Of­fice united the Bei­jing Mu­nic­i­pal Ed­u­ca­tion Com­mis­sion to com­pile and print 80,000 copies of the In­tel­lec­tual Prop­erty Ed­u­ca­tion Plan for Bei­jing Mu­nic­i­pal Mid­dle and Pri­mary Schools and In­tel­lec­tual Prop­erty Ed­u­ca­tion Man­ual for Mid­dle and Pri­mary Schools to carry out ed­u­ca­tion of in­tel­lec­tual prop­erty in mid­dle and pri­mary schools in Chang­ping District and Tongzhou District. Peo­ple’s Procu­ra­torate of Bei­jing Mu­nic­i­pal­ity, through a series ac­tiv­i­ties like “Go­ing out and Bring­ing in” to pro­vide ser­vice and guid­ance to the en­ter­prises un­der its ad­min­is­tra­tion, have ef­fec­tively curbed in­fringe­ments.

2017 is a big year for build­ing a strong coun­try in in­tel­lec­tual prop­erty and im­ple­ment­ing the State In­tel­lec­tual Prop­erty Safe­guard­ing and Util­i­aing Plan dur­ing the 13th Five-year Plan (2016–2020). Bei­jing Mu­nic­i­pal­ity will fo­cus on ad­vanc­ing it­self into in­tel­lec­tual prop­erty pro­tec­tion, and make ef­forts in im­prov­ing its qual­ity of cre­ativ­ity, util­i­sa­tion ben­e­fits, safe­guard­ing, man­age­ment abil­i­ties and level of ser­vice.
