Drug farmer sen­tenced to four years

Ag­gra­vat­ing fac­tor was the in­tent of sell­ing il­licit drugs, Jus­tice Per­era

A49-year- old farmer has been sen­tenced to four years and nine months im­pris­on­ment for two counts of un­law­ful pos­ses­sion of il­licit drugs. Iliesa Tuituba was sen­tenced by Jus­tice Vin­cent Per­era at the High Court in Suva last Fri­day. Tuituba was ar­rested on Novem­ber 4, 2014. He was granted bail on June 30 last year but was later re­voked on March 24 this year.

Jus­tice Per­era con­sid­ered this time spent in cus­tody and ruled that the ac­cused serve a term of four years and a non-pa­role pe­riod of two years, nine months.

Mean­while, on the first count, the court heard that on Novem­ber 4, 2014 the ac­cused un­law­fully cul­ti­vated 443.6 grams of il­licit drugs known as cannabis. On the sec­ond count, the court heard that on the same date at Wainadoi, Navua the ac­cused un­law­fully cul­ti­vated 7.6 kilo­grams of il­licit drugs known as cannabis.

While de­liv­er­ing his sen­tence, Jus­tice Per­era said the ag­gra­vat­ing fac­tor had been that of what the pros­e­cu­tion had stated that the ac­cused had the in­ten­tion of sell­ing the il­licit drug to users.
