Ki­laiver­ata found guilty

Ajudge in High Court in Suva said yes­ter­day that look­ing at the way Usaia Ki­laiver­ata had as­saulted his part­ner, he in­tended to kill her. Jus­tice Priyan­tha Fer­nando made this com­ment while con­vict­ing Ki­laiver­ata for mur­der. He con­curred with the as­ses­sors who also found Ki­laiver­ata guilty of mur­der. Jus­tice Fer­nando said: “The as­ses­sors did not be­lieve the de­fence story that the de­ceased fell on the gas tank and that it was an ac­ci­dent.” Ki­laiver­ata, on April 4, 2015, mur­dered his de facto part­ner, McGowan. The court heard that Ki­laiver­ata had ad­mit­ted in his cau­tion in­ter­view that he had punched the de­ceased and had also kicked her face. He had fur­ther ad­mit­ted that af­ter beat­ing her up and see­ing that the de­ceased was not breath­ing, he tried to give mouth to mouth CPR to re­vive her. The de­fence and prose­cu­tion will sub­mit their sen­tenc­ing sub­mis­sions and mit­i­ga­tion later to­day.
