Judge seeks med­i­cal ex­am­i­na­tion report of al­leged rapist

Judge Jus­tice Riyaaz Hamza has sought the med­i­cal ex­am­i­na­tion of a 73-year-old man charged with four counts of rape and three counts of sex­ual as­sault.

Mr Hamza has or­dered both de­fence and state coun­sels to as­cer­tain the ac­cused's phys­i­cal con­di­tion as to why he can­not stand in the dock.

State coun­sel Lave­nia Bog­i­tini in­formed the court that a med­i­cal ex­am­i­na­tion has been con­ducted on the ac­cused how­ever they have not re­ceived the report in re­gards to his phys­i­cal con­di­tion.

The al­leged in­ci­dents oc­curred be­tween Jan­uary 1, 1982 and Novem­ber 21, 2016 in Raki­raki and Suva.

It is al­leged that the ac­cused had raped his daugh­ter when she was 15-years-old and had im­preg­nated her.

It is fur­ther al­leged that he had raped his daugh­ter's daugh­ter as well.

The case has been ad­journed to Oc­to­ber 11, for men­tion.
