Wife gives ev­i­dence against hus­band

Awoman ac­cus­ing her hus­band of rape told the court yes­ter­day that she did not con­sent to sex­ual in­ter­course on nu­mer­ous oc­ca­sions when her hus­band al­legedly raped her re­gard­less of her re­fus­ing.

The ac­cused, 31, is charged with four counts of rape.

The mat­ter was heard be­fore Judge Jus­tice Riyaaz Hamza at the Suva High Court yes­ter­day.

The ac­cused is al­leged to have raped his wife with an egg­plant. The al­leged in­ci­dent oc­curred be­tween Novem­ber 30, 2015 and Jan­uary 5, 2016. State coun­sel Shirley Ti­vao asked the wife how was her re­la­tion­ship with her hus­band.

The wife told the court that the first two years of their mar­riage was re­ally smooth but af­ter that the cou­ple had a lot of ar­gu­ments which ended with the hus­band al­legedly forc­ing her into sex. She fur­ther told the court that on one oc­ca­sion when she re­turned home at 5pm af­ter work the cou­ple had din­ner then went to bed and again they started ar­gu­ing. She al­leges that her hus­band asked to have sex but she re­fused claim­ing to be tired from work.

“We ar­gued and he force­fully had sex with me two times and be­cause I was push­ing him off he got ag­gres­sive and put an egg­plant in­side; at first I felt some­thing dif­fer­ent but I didn’t know it was an egg­plant un­til I switched on the lights and saw the egg­plant be­side the bed,” she said.

Dur­ing cross-ex­am­i­na­tion de­fence coun­sel Talei Kean ques­tioned the wife on why she had not told the Po­lice that he was ag­gres­sive to which she said that she did but the Po­lice had not noted it down. The case con­tin­ues to­day.
