Re­de­vel­op­ment of MHADA Build­ings and Cess Build­ings

Re­con­struc­tion or Re­de­vel­op­ment of cessed build­ings in the Is­land City by Co-op­er­a­tive Hous­ing So­ci­eties or of old build­ings be­long­ing to the Cor­po­ra­tion or of old build­ings be­long­ings to the Po­lice Depart­ment is per­mit­ted in ac­cor­dance with the Rule 33(7) of the Devel­op­ment Con­trol Reg­u­la­tions of 1991 for Gr. Mumbai and amended upto 15th Au­gust 2007, some of the ba­sic prin­ci­pals and pro­vi­sions thereof are as un­der:For re­con­struc­tion/re­de­vel­op­ment to be un­der­taken by Co­op­er­a­tive Hous­ing So­ci­eties of ex­ist­ing ten­ants or by Co­op­er­a­tive Hous­ing So­ci­eties of land­lords and/or oc­cu­piers of a cessed build­ings of ‘A’ cat­e­gory in Is­land City which at­tracts the pro­vi­sions of MHADA Act, 1976 and for re­con­struc­tion/ re­de­vel­op­ment of build­ings of the Cor­po­ra­tion and Depart­ment of Po­lice, Po­lice Hous­ing Cor­po­ra­tion, Jail and Home Guard of Gov­ern­ment of Ma­ha­rash­tra con­structed prior to 1940, the Floor Space In­dex shall be 2.5 on the gross plot area of the FSI re­quired for re­ha­bil­i­ta­tion of ex­ist­ing ten­ants plus in­cen­tive FSI as spec­i­fied in Ap­pen­dix-III whichever is more. Fol­low­ing are salient fea­tures:1. The new build­ing may be per­mit­ted to be con­structed in pur­suance of an ir­rev­o­ca­ble writ­ten con­sent by not less than 70 per­cent of the oc­cu­piers of the build­ing. 2. All the oc­cu­pants of the old build­ing shall be re-ac­com­mo­dated in the re­de­vel­oped new build­ing. 3. Each oc­cu­pant shall be re­ha­bil­i­tated and given the car­pet area oc­cu­pied by him for res­i­den­tial pur­pose in the old build­ing sub­ject to the min­i­mum car­pet area of 20.90 sqmt. (225 sqft) and/or max­i­mum car­pet area upto 70 sq.mt. (753 sqft) as pro­vided in the MHADA Act, 1976. 4. In case of au­tho­rised non­res­i­den­tial oc­cu­pier the area to be given in the re­con­structed build­ing will be equiv­a­lent to the area oc­cu­pied in the old build­ing. 5. The F.S.I. for re­ha­bil­i­ta­tion of ex­ist­ing ten­ants / oc­cu­piers in a re­con­structed build­ing and in­cen­tive F.S.I. that will be avail­able shall be as un­der:(a) In case of re­de­vel­op­ment of ‘A’ cat­e­gory cessed build­ings un­der­taken by land­lord and/or Co-op­er­a­tive Hous­ing So­ci­eties of land­lord and/or oc­cu­piers, the to­tal F.S.I. shall be 2.5 of the gross plot area of the F.S.I. re­quired for re­ha­bil­i­ta­tion of ex­ist­ing oc­cu­piers plus 50% in­cen­tive F.S.I. whichever is more. (b) In case of re­de­vel­op­ment scheme of ‘B’ cat­e­gory cessed build­ings un­der­taken by land­lord and/or Co-op­er­a­tive Hous­ing So­ci­eties of land­lord and/or oc­cu­piers, the to­tal F.S.I. shall be the F.S.I. re­quired forr eha­bilita-- tion of ex­ist­ing oc­cu­piers plus 50% in­cen­tive F.S.I. (c) In case of com­pos­ite re­de­vel­op­ment of ‘A’, ‘B’ and ‘C’ cat­e­gory cessed build­ings de­clared as danger­ous by the Board be­fore Mon­soon of 1997, the per­mis­si­ble F.S.I. for re­de­vel­op­ment un­der­taken by the land­lord and/or Co-op­er­a­tive Hous­ing So­ci­eties of land­lord and/or oc­cu­piers will be as avail­able for ‘A’ cat­e­gory cessed build­ings men­tioned in Sub-clause (a) above.

In case of re­de­vel­op­ment of ‘A’ cat­e­gory cessed build­ings un­der­taken by land­lord and/or Co-op­er­a­tive Hous­ing So­ci­eties of land­lord and/or oc­cu­piers, the to­tal F.S.I. shall be 2.5 of the gross plot area of the F.S.I. re­quired for re­ha­bil­i­ta­tion of ex­ist­ing oc­cu­piers plus 50% in­cen­tive F.S.I. whichever is more.
