Sec­tion 42 (3)

This sec­tion pri­mar­ily gives de­tails on pro­vi­sions of ‘open ac­cess’. If an ap­pli­ca­tion is made by a con­sumer to a dis­tri­bu­tion li­censee for sup­ply of elec­tric­ity in a par­tic­u­lar area, such dis­tri­bu­tion li­censee can re­quest an­other dis­tri­bu­tion li­censee in the area to pro­vide it a net­work to wheel elec­tric­ity to the con­sumer.

Sec­tion 43

If in a par­tic­u­lar area the lo­cal author­ity has its net­work and it does not per­mit wheel­ing of elec­tric­ity by shar­ing its net­work with the other dis­tri­bu­tion li­censee, then an­other dis­tri­bu­tion li­censee will have to pro­vide elec­tric­ity from its own net­work. For this pur­pose, the li­censee has to lay down its net­work if re­quired in or­der to sup­ply elec­tric­ity to a con­sumer seek­ing sup­ply. The pro­vi­sion of ‘open ac­cess’ em­pow­ers con­sumers with the right to get sup­ply from a com­pany other than the dis­tri­bu­tion li­censee of their area.
