I booked a flat with Unitech (Har­mony) in July 2011 on cash-down pay­ment ba­sis at the cost of Rs 1.75 crore. Han­dover of the flat was promised by the last day of De­cem­ber in the same year. As per the agree­ment, Unitech is li­able to pay Rs 5 per square foot in case of de­lay. As of now, the work on the site is vir­tu­ally at a stand­still. Re­peated prom­ises ob­tained in writ­ing have not ma­te­ri­al­ized. Arun Kapoor There are cases where con­sumer fo­rums have fined builders for not de­liv­er­ing the flat as per the agree­ment. They have been di­rected to re­fund the de­posited money with in­ter­est at the rate of 18 per cent per an­num. In your case, give a no­tice to the man­ag­ing direc­tor of Unitech for com­mit­ting de­fault as per agree­ment and claim re­fund or the agreed payable in­ter­est. If the com­pany fails to re­spond, you may lodge a for­mal com­plaint at the dis­trict con­sumer fo­rum.
