While you are en­ter­ing into a tri­par­tite agree­ment with the builder, en­sure that a) the date of pos­ses­sion is clearly stated in the agree­ment, b) there is a clause that states that a penalty will be im­posed on the de­vel­oper, and c) the amount of penalty (ei­ther per­cent­age of the value of property, the EMI of the loan be­ing paid, or a fixed amount) is clearly men­tioned in the agree­ment.
