‘File FIR against 7 builders if flats not reg­is­tered in a week’

NOIDA: Gau­tam Budh Na­gar dis­trict mag­is­trate on Tuesday di­rected the stamp and reg­is­tra­tion depart­ment to file an FIR against seven builders if they fail to get flats registry ex­e­cuted as per law in a week’s time.

DM BN Singh’s or­der came af­ter the DM learnt that seven builders — Am­ra­pali Group, Divine India Pri­vate Limited, As­sotech, Vic­tory Cross Road, Real­tors Pri­vate Limited, AGC Aj­nara Homes and Gar­de­nia Aims Glory have given pos­ses­sion to buy­ers with­out ob­tain­ing oc­cu­pancy cer­tifi­cate from the Noida author­ity.

The ad­min­is­tra­tion of­fi­cials along with the stamp and reg­is­tra­tion staff also took a meet­ing with the builders and di­rected them not to give pos­ses­sion of the flats with­out registry ex­e­cu­tion with the re­spec­tive buy­ers. The DM took this step be­cause the UP govern­ment is los­ing rev­enue due to non-registry of the flats.

“Since the seven builders have of­fered pos­ses­sion to 10,318 home­buy­ers with­out ex­e­cu­tion of registry, the state govern­ment has lost rev­enue of ₹334.13 crore. Un­der sec­tion 64 of the UP Stamp Act, the stamp and reg­is­tra­tion depart­ment should file an FIR against the builders. The FIR will be filed af­ter send­ing a week’s no­tice to the builders,” Singh said.

The DM also di­rected the stamp and reg­is­tra­tion depart­ment to con­duct in­spec­tion at the hous­ing projects, where the buy­ers have shifted into flats with­out ex­e­cu­tion of registry.

“The stamp and reg­is­tra­tion team will also in­spect to ver­ify that if the builders have of­fered pos­ses­sion to buy­ers with­out the Noida Author­ity is­su­ing them oc­cu­pancy cer­tifi­cate as per law. The builders must also en­sure that they of­fer pos­ses­sion to buy­ers only af­ter de­vel­op­ing ad­e­quate com­mon fa­cil­i­ties such as sewage con­nec­tion, drink­ing wa­ter sup­ply, com­mu­nity cen­tre, lift, etc,” said Singh.

Ac­cord­ing to Sec­tion 13 of the UP Apart­ment (pro­mo­tion of con­struc­tion own­er­ship and main­te­nance) Act, 2010, a builder can­not al­low pos­ses­sion or trans­fer of own­er­ship right with­out ex­e­cut­ing the reg­is­tra­tion of the flat.

The stamp and reg­is­tra­tion depart­ment had on Jan­uary 21 started is­su­ing no­tices to the builders.
