High court directs govt to fill six APO posts from waiting list

The Allahabad high court on Tuesday directed the UPPSC and the state government to fill six posts of assistant prosecutio­n officers (APO), which remained vacant as successful candidates did not join service.

These posts will be filled with the candidates who are next in merit on the waiting list.

The court also directed the UP Public Service Commission (UPPSC) and the government to file an affidavit explaining why candidates were selected only for 72 posts, though 102 vacancies were advertised in 2011.

The bench comprising justice AP Sahi and justice DS Tripathi passed the order while hearing a petition filed by Ramesh Kumar Raina. Appearing for Raina, advocate Siddharth Khare argued that the petitioner was next on waiting list which was prepared for selection of 72 candidates. “Out of these, six successful candidates did not join the service. Therefore, as per rules, UPPSC should recommend the names of candidates who are next on the merit list,” he said.

Fixing July 3 as the next date of hearing, the court asked the state government to fill six vacant posts within three weeks.

The UPPSC had issued an advertisem­ent for recruitmen­t of 102 APOs on August 13, 2011. The written examinatio­ns (preliminar­y and main) were conducted in 2014. Interviews were held in 2016 after which 72 candidates were selected.
