FDA of­fi­cial, cop get show- cause no­tice

THANE: The Thane district court has is­sued a show-cause no­tice to an of­fi­cial of Food and Drug Ad­min­is­tra­tion and a po­lice in­spec­tor for de­stroy­ing seized gutkha worth more than Rs1.70 lakh with­out tak­ing per­mis­sion from court.

In March 2014, the FDA of­fi­cials seized gutka from a per­son in Ut­tan, Bhayan­der, and filed a com­plaint with the po­lice.

Dur­ing t he hear­ing, t he court told the FDA and the po­lice depart­ment to pro­duce the seized goods. But, it was shocked to know that the seized goods had been de­stroyed.

Tak­ing a se­ri­ous view of the lapse by of­fi­cials, as­sis­tant ses­sions judge NN Sri­man­gale or­dered t hat a show- cause no­tice be is­sued to the two of­fi­cials.

The next date of hear­ing is Fe­bru­ary 3 and they are sup­posed to give their replies by then.

On Au­gust 5 and 6, 2014, the FDA de­stroyed the seized gutkha worth crores at a fa­cil­ity at Navi Mum­bai.

When the court wanted the FDA of­fi­cials to show the seized goods, they were un­able to do so.

The seized gutkha had been de­stroyed with­out per­mis­sion from the court.

Tak­ing a se­ri­ous note of the flout­ing of rules, the judge or­dered is­su­ing show- cause no­tices to the FDA ad­min­is­tra- tive of­fi­cer Man­ick Jad­hav and po­lice in­spec­tor in charge of the Ut­tan po­lice sta­tion un­der Thane district ru­ral po­lice Priy­atama Muthe.

The pros­e­cu­tion is likely to file an ap­pli­ca­tion in court un­der sec­tion 201, ask­ing the court to make the two of­fi­cials an ac­cused in the case.
