‘De­fault­ing in­dus­tri­al­ists to face ac­tion’

Mu­nic­i­pal com­mis­sioner Tukaram Mundhe has warned of stern ac­tion against in­dus­tri­al­ists who do not clear their tax dues. He has said he will take en­force­ment ac­tion if re­quired.

The Small Scale En­trepreneurs As­so­ci­a­tion (SSEA) had re­cently an­nouned that its mem­bers will not pay taxes to NMMC till a fi­nal de­ci­sion is made by the Supreme Court on the is­sue.

Mundhe said, “Their ba­sic con­tention is that NMMC has no author­ity over them. They had moved high court on this point which in 2010 said that NMMC is the lo­cal lo­cal body and that they will have to pay.”

He added, “They ap­pealed to the Supreme court which has not given any stay till date and so I do not have to stop col­lect­ing taxes.”

Mundhe said, “I un­der­stand that de­spite the HC order of 2010, there was a gen­eral body res­o­lu­tion through which they were given some six months amnesty to pay.”

Ac­cord­ing to Mundhe the is­sue has been go­ing on for 15 years. “All I am say­ing is pay now. If SC rules in their favour, they will get a re­fund. It should have been im­ple­mented ear­lier.”

Mundhe said, “Pay ar­rears or else your bank ac­count will be seized, then debtors at­tached, then prop­erty will be seized and auc­tioned. I have started with the first step of seiz­ing their ac­count. If they do not com­ply, I will go on to the debtors and their prop­erty.”
