Kalyan youth will not be charged by NIA for join­ing ISIS

Areeb Ma­jeed, the only In­dian to return af­ter join­ing the Is­lamic State (ISIS) in Iraq, will not be charged for be­ing a mem­ber of a ter­ror­ist or­gan­i­sa­tion, a spe­cial Na­tional In­ves­ti­ga­tion Agency (NIA) court said on Wed­nes­day. He along with three oth­ers had gone to Iraq to join the ter­ror group in May 2014.

The move could set prece­dent for how ISIS re­cruits who come back to In­dia are tried. The court dropped sec­tion 20 of the Un­law­ful Ac­tiv­i­ties (Pre­ven­tion) Act, over a tech­ni­cal­ity that when Areeb al­legedly joined the ISIS, the or­gan­i­sa­tion had not been de­clared a ter­ror­ist out­fit under In­dian Law. The court up­held other charges under UAPA and the In­dian Pe­nal Code (IPC).
