Land acquisition fi­asco: The af­ter­math

Some de­vel­op­ers did not can­cel book­ings for apart­ments. Oth­ers of­fered op­tions that were not good enough

It was tough. Though peo­ple had in­vested money in var­i­ous projects, many of them had to wait in agony when the land acquisition prob­lem held up con­struc­tion work in Noida Ex­ten­sion. Later af­ter the is­sue was re­solved and com­pen­sa­tion or­dered for the farmers by the court, work on the projects be­gan again… but with de­lays and can­cel­la­tions of book­ings etc. Ab­nish Ku­mar and Dr Ashok Hansaria share their ex­pe­ri­ences with you

Ab­nish Ku­mar, a life in­surance agent, bought a 2BHK 900 sq ft apart­ment in Am­ra­pali’s Le­siure Park in Noida Ex­ten­sion way back in 2010, much be­fore the land acquisition prob­lem. The unit cost him around R18 lakh. He had ini­tially made a pay­ment of about 9% and was ap­pre­hen­sive that his book­ing would be can­celled since he had not paid up 10% when the Noida Ex­ten­sion story hit the head­lines. “But the de­vel­oper did not can­cel my book­ing and I am grate­ful for him for that. They send me a de­mand to pay up some 40% in March this year, which I did. Around eight floors have al­ready been con­structed and I hope they hand over the unit to me by De­cem­ber 2014.”

Dr Ashok Hansaria has an­other tale to tell. He had booked a 3BHK unit in 2010 un­der a con­struc­tion­linked plan in Eco Vil­lage 2 in the Shaberi area. Af­ter the Supreme Court order, the de­vel­oper gave them the op­tion of ei­ther tak­ing the re­fund or shift­ing to an al­ter­na­tive site. “We told the de­vel­oper that we re­quire the flat and not the money. We were first given an op­tion to shift to the Cape Town project but we found that it would not be af­ford­able for us and asked to be shifted to Eco Vil­lage 3 un­der the same terms and con­di­tions. I wrote them to send me a de­mand let­ter and my pay­ment sched­ule. In­stead, they sent me a can­cel­la­tion let­ter on May 8, 2013. Now when con­struc­tion has al­ready started, why are they send- ing me a can­cel­la­tion let­ter? And that too when prices have in­creased. I have now sent them a le­gal no­tice but there has been no an­swer. I hope I get my flat”
