The re­la­tion­ship be­tween a land­lord and a ten­ant is gov­erned by the agree­ment that ex­pressly stip­u­lates the rights and obli­ga­tions of the par­ties. The agree­ment is en­force­able by law, and pro­vides the re­cip­ro­cal rights and li­a­bil­i­ties of the con­tract­ing par­ties. How­ever, in the ab­sence of an agree­ment or lo­cal us­age to the con­trary, the land­lord and the ten­ant of im­move­able prop­erty pos­sess the fol­low­ing ma­jor rights and li­a­bil­i­ties, amongst oth­ers. any en­croach­ment made upon, or any in­ter­fer­ence with the land­lord’ s rights con­cern­ing such prop­erty.
