Gan­gele Moves SC Against Ra­jya Sabha Panel In­quiry

Mad­hya Pradesh High Court judge S K Gan­gele, who is fac­ing im­peach­ment pro­ceed­ings in Par­lia­ment over a sex­ual ha­rass­ment charges lev­elled against him by a lady dis­trict judge of the state, on Wed­nes­day moved the SC against the pro­ce­dure adopted by a Ra­jya Sabha panel to in­quire into the charges against him. An in-house ju­di­cial panel of the top court had ear­lier cleared him of the charges on the ground of lack of ev­i­dence. But a house panel com­pris­ing SC judge Jus­tice R Banu­mathi among oth­ers is cur­rently in­quir­ing into the charges afresh. The judge, sources said, was ag­grieved by the panel de­ci­sion to al­low the lady judge to cross-ex­am­ine him dur­ing the en­quiry. The plea was men­tioned be­fore a top court bench, com­pris­ing Jus­tices Jasti Che­lameswar and Ab­hay Manohar Sapre, but Jus­tice Sapre re­cused him­self from hear­ing the case. The plea will now be men­tioned again be­fore a bench led by Chief Jus­tice JS Khe­har to be listed for hear­ing be­fore a bench which does not in­clude Jus­tice Sapre. The lady judge had ac­cused Gan­gele of ask­ing her to gy­rate to some sug­ges­tive lyrics at an of­fi­cial gath­er­ing and made other sex­ual in­nu­en­does, a charge the judge has de­nied. She has al­leged that she was trans­ferred to a re­mote area af­ter she brushed him off. She re­signed and wrote to the CJI and the Pres­i­dent of her al­leged ha­rass­ment in her res­ig­na­tion let­ter. – Sa­man­waya Rau­tra
