Oct 31 date for de­ci­sion on sym­bol row, EC told

OB­SERV­ING that the Elec­tion Com­mis­sion (EC) is not ex­pected to keep pro­ceed­ings on de­cid­ing the AIADMK ‘two leaves’ sym­bol row pend­ing in­def­i­nitely, the Madu­rai Bench of the HC has di­rected the EC to dis­pose of the mat­ter by Oc­to­ber 31.

Dis­pos­ing a PIL pe­ti­tion by an AIADMK cadre Ramku­mar Adityan, a Bench com­pris­ing Jus­tices K K Sasid­ha­ran and G R Swami­nathan said this is more in the sub­ject case on ac­count of the di­rec­tion given by the Prin­ci­pal Bench of the HC to gov­ern­ment to hold elec­tions to lo­cal bod­ies by Novem­ber 17, 2017. “Any de­lay in the mat­ter would se­ri­ously ham­per the func­tion­ing of the po­lit­i­cal par­ties,” the judges ob­served. Point­ing out the fast ap­proach of EC in de­cid­ing dis­pute in­volv­ing the Sa­ma­jwadi Party, the judges said that though the ri­val groups of AIADMK were re­spon­si­ble for de­lay, that can­not be the rea­son for keep­ing pro­ceed­ings pend­ing.

“The ECI must fix a dead­line for com­ple­tion of plead­ings and pro­duc­tion of doc­u­ments for pur­pose of tak­ing up the mat­ter for fi­nal dis­posal”, the bench said.

Fur­ther the judges di­rected the EC to dis­pose of pro­ceed­ings in the dis­pute case filed by (the then) both fac­tions of AIADMK, as per law, as ex­pe­di­tiously as pos­si­ble and in any case, on or be­fore Oc­to­ber 31.
