Court junks instant talaq, gives victim maintenance
Bareilly: A day after a family court declared the instant talaq of 23-year-old Nida Khan as invalid and directed her husband to give her monthly maintenance of Rs 12,000, Nida told TOI that she now wants imprisonment for her husband, Sheeran Raza Khan, and was waiting for the law on triple talaq to come into force.
Nida, who is currently pursuing LLB, wants to fight for justice for triple talaq victims and is currently helping around 20 such women. Her husband Sheeran Raza is the nephew of Subhan Raza Khan, head of influential Dargah Aala Hazrat, which is followed by lakhs of Mus- lims of Sunni Barelvi sect.
“I want him to serve at least seven years in prison for destroying my life. The central government should amend the bill and increase the term of punishment from three to seven years. After I filed a case of domestic violence against Sheeran and his par- ents in July 2016, he claimed in court that he had given triple talaq to me in February that year. I was devastated. Even though I have won the maintenance case, I am still fighting the domestic violence case,” she said.
Nida, who aspires to become a lawyer, added, “Victims of triple talaq and domestic violence can get justice only through courts. However, most of them can’t afford good lawyers. I have decided to fight for the rights of such women.”
Nida said that soon after getting married to Sheeran on February 18, 2015, her inlaws started torturing her for dowry. “My husband and his family wanted an SUV which my parents couldn’t afford. They sacked all maids and made me do the household work. When I went to appear in my M Com first year exam in March that year, Sheeran chased me and did not allow me to sit for the paper. In July when I told my in-laws that I was pregnant, they assaulted me and later threw me out of the house. On visiting a doctor I learnt that I had suffered a miscarriage due to the beating,” she said.
