Judge throws out case against driver
JUDGE Murrough Connellan dismissed the case of an Eastern European man because the evidence heard in Bray District Court was deemed inept.
Lukasz Swierczer of 57 The Green, Woodbrook Glen was before the court on a summons for careless driving on the Bray Road in Greystones on June 4 last year.
The court heard evidence from a woman who made a complaint to Gardaí at Greystones that a Black BMW had overtaken eight cars including her own.
The woman took the details of the BMW and then drove up beside it at traffic lights and had a look at the driver before she turned right. She identified him in court as Swierczer.
The Defence Solicitor told Judge Murrough Connellan that there was a clear dispute on the facts as Swierczer denied the incident.
Swierczer said that a few hundred metres away from the traffic lights a car pulled out from a left turn and that he swerved to avoid it.
‘I was stopped at the traffic lights when a woman pulled up beside me and started pointing at her head saying that I was crazy,’ he said.
Judge Murrough Connellan dismissed the summons on the basis of the prosecution’s evidence of the location being totally inept.
