Judge throws out case against driver

JUDGE Mur­rough Con­nel­lan dis­missed the case of an East­ern Euro­pean man be­cause the ev­i­dence heard in Bray District Court was deemed in­ept.

Lukasz Swier­czer of 57 The Green, Wood­brook Glen was be­fore the court on a sum­mons for care­less driv­ing on the Bray Road in Grey­stones on June 4 last year.

The court heard ev­i­dence from a woman who made a com­plaint to Gar­daí at Grey­stones that a Black BMW had over­taken eight cars in­clud­ing her own.

The woman took the de­tails of the BMW and then drove up be­side it at traf­fic lights and had a look at the driver be­fore she turned right. She iden­ti­fied him in court as Swier­czer.

The De­fence So­lic­i­tor told Judge Mur­rough Con­nel­lan that there was a clear dis­pute on the facts as Swier­czer de­nied the in­ci­dent.

Swier­czer said that a few hun­dred me­tres away from the traf­fic lights a car pulled out from a left turn and that he swerved to avoid it.

‘I was stopped at the traf­fic lights when a woman pulled up be­side me and started point­ing at her head say­ing that I was crazy,’ he said.

Judge Mur­rough Con­nel­lan dis­missed the sum­mons on the ba­sis of the prose­cu­tion’s ev­i­dence of the lo­ca­tion be­ing to­tally in­ept.
