Jail for man who sex­u­ally as­saulted woman at club

AN AVOCA MAN charged with sex­ual as­sault within an Ark­low li­censed premises and threat­en­ing, abu­sive and in­sult­ing be­hav­iour has been sen­tenced to nine months in prison at District Court.

The court heard that Luke Flem­ing with an ad­dress at Bal­ly­ga­han, Avoca pleaded guilty to the of­fences dated April 29, 2007 at Ras­cal’s and on Main Street, Ark­low.

Garda Mar­ion Galvin told the court that the in­jured party was danc­ing with friends on the night in ques­tion when Flem­ing ap­proached her and put his hand up the front of her skirt and moved his fin­gers around. She pushed him away.

When Gar­dai ar­rived on the scene out­side the premises Flem­ing con­tin­ued to make deroga­tory com­ments about the in­jured party and then clenched his fist close to her face and said ‘woman or not I’ll put you to the ground’.

Garda Galvin added that the de­fen­dant told her he re­mem­bers his friends telling him of the in­ci­dent but he does not re­mem­ber it clearly him­self as he drank a bot­tle of vodka that night. The court was told that he had his ups and downs in re­la­tion to sub­stance abuse and had an ap­point­ment with a coun­seller and that he pleaded guilty to spare the vic­tim the trauma of giv­ing ev­i­dence.

Judge Mur­rough Con­nel­lan said that be­ing drunk is not an ex­cuse for such be­hav­iour and that ev­ery per­son has the right to go out and en­joy them­selves without fear of any type of as­sault, not least that of a sex­ual na­ture.
