Jail for man who sexually assaulted woman at club
AN AVOCA MAN charged with sexual assault within an Arklow licensed premises and threatening, abusive and insulting behaviour has been sentenced to nine months in prison at District Court.
The court heard that Luke Fleming with an address at Ballygahan, Avoca pleaded guilty to the offences dated April 29, 2007 at Rascal’s and on Main Street, Arklow.
Garda Marion Galvin told the court that the injured party was dancing with friends on the night in question when Fleming approached her and put his hand up the front of her skirt and moved his fingers around. She pushed him away.
When Gardai arrived on the scene outside the premises Fleming continued to make derogatory comments about the injured party and then clenched his fist close to her face and said ‘woman or not I’ll put you to the ground’.
Garda Galvin added that the defendant told her he remembers his friends telling him of the incident but he does not remember it clearly himself as he drank a bottle of vodka that night. The court was told that he had his ups and downs in relation to substance abuse and had an appointment with a counseller and that he pleaded guilty to spare the victim the trauma of giving evidence.
Judge Murrough Connellan said that being drunk is not an excuse for such behaviour and that every person has the right to go out and enjoy themselves without fear of any type of assault, not least that of a sexual nature.
