Uninsured driver ‘took a chance’
CHARGES against a man who drove without a licence or insurance disc in order to pick up his sick daughter have been dismissed at Arklow District Court.
Emmet Donnelly with an address at 1 Gorse Haven, Coolboy, Tinahely was charged on April 22, 2008 with failure to produce documents, driving without a licence and non display of discs.
The court heard that Donnelly accepted he did not have adequate documentation but took a chance when he received a call to pick up his daughter from school as she was ill.
Garda James Lillis confirmed to the court that this was the case and said he drove the defendant to the school after he was stopped.
Judge Murrough Connellan said he would dismiss the charges with the Probation Act due to the circumstances.
