Unin­sured driver ‘took a chance’

CHARGES against a man who drove without a li­cence or in­sur­ance disc in or­der to pick up his sick daugh­ter have been dis­missed at Ark­low District Court.

Em­met Don­nelly with an ad­dress at 1 Gorse Haven, Cool­boy, Ti­na­hely was charged on April 22, 2008 with fail­ure to pro­duce doc­u­ments, driv­ing without a li­cence and non dis­play of discs.

The court heard that Don­nelly ac­cepted he did not have ad­e­quate doc­u­men­ta­tion but took a chance when he re­ceived a call to pick up his daugh­ter from school as she was ill.

Garda James Lil­lis con­firmed to the court that this was the case and said he drove the de­fen­dant to the school af­ter he was stopped.

Judge Mur­rough Con­nel­lan said he would dis­miss the charges with the Pro­ba­tion Act due to the cir­cum­stances.
