Driver didn’t get penalty notice
A CHARGE against a man who admitted to speeding has been struck out at Arklow District Court as he never received a fixed penalty notice.
Dermot Fortune from 43 Etchingham Heights, Riverchapel was charged after Garda Hayes recorded him travelling at 140km in a 100km per hour zone on the N11 on July 11, 2008.
Fortune told the court that the first notification he received was the court summons and that he would have paid the initial fine had he received it.
Judge Murrough Connellan noted this and struck out the charge.
