Driver didn’t get penalty no­tice

A CHARGE against a man who ad­mit­ted to speed­ing has been struck out at Ark­low District Court as he never re­ceived a fixed penalty no­tice.

Der­mot For­tune from 43 Etch­ing­ham Heights, River­chapel was charged af­ter Garda Hayes recorded him trav­el­ling at 140km in a 100km per hour zone on the N11 on July 11, 2008.

For­tune told the court that the first no­ti­fi­ca­tion he re­ceived was the court sum­mons and that he would have paid the ini­tial fine had he re­ceived it.

Judge Mur­rough Con­nel­lan noted this and struck out the charge.
