‘Mis­led’ court on past record

A BRAY MAN who ‘mis­led’ the court had a con­vic­tion he re­ceived in the District Court af­firmed when he ap­peared be­fore last week’s sit­ting of Wick­low Cir­cuit Court.

David Dunne, 4 Raf­ferty Vil­las, Bray had been con­victed of drunken driv­ing and state so­lic­i­tor Rory Benville told Judge Ger­ard Grif­fin that the ap­peal had been heard in April 2008 and Dunne had told the court un­der oath that he had no pre­vi­ous con­vic­tions. How­ever, he said that Dunne did in fact have a pre­vi­ous con­vic­tion and he had ‘mis­led’ the court. Dunne was not in court and Judge Grif­fin struck out the ap­peal and af­firmed the or­der of the District Court.
