Man lucky to get off, says judge
A MAN accused of driving over the legal alcohol limit had the case dismissed as the location on the charge sheet was incorrect.
Brian Mohan (40), 22 O’Byrne Road, Bray, was accused of committing the offence at Vevay Road in Bray on August 31, 2016.
However, Mohan had turned onto Charnwood when stopped by gardaí.
The court heard that gardaí saw Mohan driv- ing at speed towards a checkpoint from the direction of the Main Street at approximately 1 a.m.
Bray District Court heard that he turned towards Charnwood and was pulled over. He failed a roadside breath test and later in the garda station, the evidenser result showed 67 microgrammes of alcohol per 100 millilitres of breath.
‘He’s lucky to get off on a technicality like that,’ said Judge David Kennedy.
