Man lucky to get off, says judge

A MAN ac­cused of driv­ing over the le­gal al­co­hol limit had the case dis­missed as the lo­ca­tion on the charge sheet was in­cor­rect.

Brian Mo­han (40), 22 O’Byrne Road, Bray, was ac­cused of com­mit­ting the of­fence at Vevay Road in Bray on Au­gust 31, 2016.

How­ever, Mo­han had turned onto Charn­wood when stopped by gar­daí.

The court heard that gar­daí saw Mo­han driv- ing at speed to­wards a check­point from the di­rec­tion of the Main Street at ap­prox­i­mately 1 a.m.

Bray Dis­trict Court heard that he turned to­wards Charn­wood and was pulled over. He failed a road­side breath test and later in the garda sta­tion, the ev­i­denser re­sult showed 67 mi­cro­grammes of al­co­hol per 100 millil­itres of breath.

‘He’s lucky to get off on a tech­ni­cal­ity like that,’ said Judge David Kennedy.
